Judge: Sticky’s Pot Shop must stop selling marijuana

Sticky’s Pot Shop in Hazel Dell must stop selling marijuana.
Superior Court Judge Daniel Stahnke ruled Tuesday that John Larson, owner of a recreational marijuana store on 9411 N.E. Highway 99, must close after violating county code. Larson opened the shop in unincorporated Clark County in violation of the county’s ban on recreational pot sales late last year.
A manager at the store declined to comment, instead directing The Columbian to Larson. He was not immediately available for comment. The store was, however, open for business, she said.
The ruling affirms the decision by a Clark County Hearing Examiner, who found Larson gave the county false information about what he planned to sell in order to obtain a building permit, and that he violated the county moratorium.
The decision revokes Larson’s building permit. The judge ruled that the store must stop selling marijuana and marijuana-infused products – such as oils or edibles – immediately. Larson must also pay a $1,500 fee imme..

Man admits shooting to protect marijuana grow

PASCO – A 24-year-old Pasco man has admitted he was protecting a backyard marijuana grow when he fired at a 16-year-old boy who reached over the fence to steal some plants.
Pedro Orta-Zuniga pleaded guilty in federal court Friday to possessing a firearm in furtherance of a drug trafficking crime. He faces at least five years in prison.
Police were called to a local hospital Oct. 1 when a boy arrived with a gunshot wound in the arm.
The teen told officers he and a friend spotted marijuana plants in a Pasco yard and wanted to steal it. When the teen reached over the fence, a man on the other side fired multiple shots.
Officers went to the home and found Orta-Zuniga hiding amid the growing area. They also found a rifle, a pistol and bullet holes in the fence.
Orta-Zuniga said he slept in the yard with the guns to protect about 15 marijuana plants from thieves.

Police: Tigard man burned while trying to make hash oil

PORTLAND — Authorities say a man has been badly burned in a hash oil explosion at his Tigard apartment.
The man, who has not been identified, was taken to a Portland hospital after the incident. An update on his condition was not known Monday.
Police had responded to his apartment Saturday night to find a window blown out and glass scattered around the parking lot.
The victim, who had been alone at the time of the explosion, came out of the apartment with visible burns to his body, neck and face.
Police say he had been trying to create hash oil, a process that involves the extraction of marijuana and use of flammables.
The incident remains under investigation.

3 years into experiment, future of hemp is hazy

PUEBLO, Colo. — Three years into the nation’s hemp experiment, a 20-acre farm in southern Colorado exemplifies the crop’s hazy potential.
Hemp could be enormously profitable, but right now there are just as many questions as answers for Will and Ally Cabaniss, two Florida natives who moved to southern Colorado to embark on the hemp business.
“Every day brings something new and different,” said Will Cabaniss, holding up a red plastic cup containing a hemp seedling awaiting planting. “Right now we’re just building data for the industry, seeing what works and what doesn’t.”
Authorized for research and experimental growth in the 2014 Farm Bill, hemp is being grown this year on only about 6,900 acres nationwide, according to industry tallies based on state reports.
The crop is still too new to be tracked by the U.S. Department of Agriculture, which has no recent estimate of market prices or commercial uses for marijuana’s nonintoxicating cousin.

Oregon buzz: Pot plants at state fair in a 1st for the US

SALEM, Ore. — Nine living marijuana plants will be displayed at the Oregon State Fair in a first of its kind event for the United States starting next Friday.
The exhibit of the non-flowering, immature plants brings pot cultivation more into the agricultural mainstream less than two years after Oregon voters legalized recreational marijuana. The Oregon Cannabis Business Council, which organized the exhibit, says it’s the first time live cannabis will be shown at a state fair anywhere in the U.S.
The group last year had an informational booth about marijuana at the fair and there were no complaints — a key factor in allowing them to go one step further and offer live plants for viewing this year, said Dan Cox, spokesman for the Oregon State Fair.
The specimens were selected by judges at a competition last weekend who chose three winners each in the sativa, indica and hybrid categories.

High court sides with employee fired for smoking pot at work

HARTFORD, Conn. — Connecticut’s top court has ruled that a state worker fired for smoking marijuana on the job in 2012 was penalized too harshly and should get his job back.
The Supreme Court justices said Friday that a lower court judge was wrong to overturn the decision of an arbitrator. The arbitrator had ordered University of Connecticut Health Center maintenance worker Gregory Linhoff suspended without pay for six months and subjected to random drug testing for one year. Officials fired Linhoff after the judge’s ruling.
State officials said allowing Linhoff to return to work would violate public policy against drug use in the workplace and send a bad message to other workers.
The Supreme Court said Linhoff deserved to be disciplined, but state policy doesn’t require firing him.

U.S. government won’t reclassify marijuana, allows research

WASHINGTON — The Obama administration will keep marijuana on the list of the most dangerous drugs, despite growing popular support for legalization, but will allow more research into its possible medical benefits, the Drug Enforcement Administration announced Thursday.
The DEA said the agency opted not to reclassify marijuana after a lengthy review and consultation with the Health and Human Services Department, which said marijuana “has a high potential for abuse” and “no accepted medical use.”
“We are tethered to science and bound by statute,” DEA spokesman Rusty Payne said Thursday.
The decision to keep marijuana in the same class of drugs as heroin and peyote comes amid growing national support for the legalization of marijuana. More than half the states have legalized the drug for either medicinal or recreational use.

First-ever marijuana fair opens in Oregon

SALEM, Ore. — People flocked to Oregon’s first-ever marijuana growers’ fair on Saturday, where a competition for best pot plants will be held with the winning entries to be displayed at the Oregon State Fair.
The inaugural two-day event being held in an exhibition hall on the Oregon State Fairgrounds underscores how the once-illicit marijuana industry is starting to go mainstream in Oregon, one of four states to have legalized recreational marijuana use, along with Washington, D.C.
Donald Morse, a pot grower who conceived the Oregon Cannabis Growers’ Fair, said attendance was strong, less than two hours after the doors opened Saturday morning. Oregon man finds portable toilet filled with pot

ROGUE RIVER, Ore. — Police in the southern Oregon community of Rogue River say a man walking through a park discovered a portable toilet filled with marijuana plants.
The agency posted a photo on social media Wednesday, saying it’s the largest seizure of pot the department has ever made.
Marijuana grows are common in southern Oregon, which has some of the nation’s best conditions for outdoor cultivation.
Chief Ken Lewis said Thursday police still don’t know how the pot got there. He said it could be anything from a pick up point to a disgruntled citizen making a statement about all the marijuana grows.
Lewis said a public works employee checked the toilet three hours before the discovery was made and it was empty. People playing tennis on a nearby court saw nothing suspicious.

Gallup: 33 million American adults use marijuana

A new Gallup poll out Monday finds that percent of American adults who say they currently smoke marijuana has nearly doubled over the past three years.
In 2013, only 7 percent of adults said they were marijuana smokers. When Gallup asked again in July of this year, 13 percent admitted to current marijuana use. That works out to more than 33 million adult marijuana users in the U.S. If America’s marijuana users resided in one state, it would be bigger than Texas and second only to California in population.
There are currently about 40 million cigarette smokers in the U.S., according to the Centers for Disease Control and Prevention. Given that cigarette use is in decline, marijuana use could become more prevalent than cigarette use in just a few years’ time.
There are likely several factors driving these numbers. Since 2013, recreational marijuana markets opened in Colorado and Washington, and several other states voted to legalize marijuana in the fall 2014. It’s likely that adults ..

What needs to change to maximize marijuana’s benefits in Washington?

If current trends keep up, that will be the value of marijuana retail and producer/processor sales in Washington state on a yearly basis. With few exceptions, state marijuana sales have risen every month since the first recreational stores opened two years ago, bringing millions in state taxes and thousands of jobs.
That’s the good news.
“The picture thus far is a curate’s egg — good in parts,” writes University of Washington professor emeritus Roger Roffman. “No policy change of this magnitude will go precisely according to plan.”

South Dakota charges 2 men trying to help launch pot resort

FLANDREAU, S.D. — Two consultants who worked with a Native American tribe on its plans to open the nation’s first marijuana resort in rural South Dakota have been charged with drug offenses, the state’s attorney general announced Wednesday.
The charges come eight months after the Flandreau Santee Sioux destroyed their crop amid fears of a federal raid, abandoning an ambitious scheme to develop “an adult playground” that they estimated could net as much as $2 million a month in profits. Tribal leaders this week said they don’t plan to revisit the proposal, and instead will use their greenhouse to grow vegetables, including tomatoes. The tribe declined immediate comment on the charges against the consultants.

Court hears appeal by Sticky’s Pot Shop

The owner of a marijuana store operating in violation of a county moratorium argued his shop’s case before a Clark County Superior Court Judge on Monday.
John Larson, who opened Sticky’s Pot Shop at 9411 N.E. Highway 99 in Hazel Dell late last year, has been in the midst of an ongoing legal battle with Clark County to fight to keep his store open.
Larson is appealing a decision by a Clark County hearings examiner who rescinded his commercial building permit, saying Larson was violating the county’s moratorium on recreational marijuana sales and had obtained a license under the pretense of selling trinkets and decorative items.
Before Superior Court Judge Daniel Stahnke, Larson argued that the county’s moratorium, approved in 2014, is in “direct opposition of state statute” allowing marijuana sales. Larson has argued before that the county’s ordinance banning recreational marijuana sales is illegal.

Oregon State Fair to feature marijuana

PORTLAND — A new crop will be featured at the Oregon State Fair this year: marijuana.
The Oregonian/Oregon Live reports that the fair awards prizes for the curviest vegetable or the most misshapen fruit. This year, marijuana plants will also be on display — and will be judged by a panel of growers before the fair.
The Oregon Cannabis Business Council is sponsoring the exhibit. Chairman Don Morse says nine plants will be displayed in a greenhouse and monitored by a security guard.
Only people age 21 and older will be allowed inside.
Fair spokesman Dan Cox says the exhibit is a nod to the newly legal status of cannabis. Morse says, however, that those hoping for a sample will be disappointed.
The fair runs Aug. 26 through Sept. 5.
